By using and paying for the services of "TEZISH"" LLC ("TEZISH," "we") ("TEZISH Application"; "tezish.com"), you agree to these Terms of Service and Privacy Policy ("Terms of Service") and The Terms of Service are legally binding. You further agree that you are at least 18 years of age and have the appropriate authority to accept these Terms.

 

PLEASE READ THE FOLLOWING TERMS OF SERVICE CAREFULLY BEFORE USING TEZISH'S SERVICES.

 

If you do not agree with the following Terms of Service, please do not use TEZISH services. These Terms of Service apply to any use of TEZISH services and the contract concluded on the basis thereof.

TEZİSH may amend the Terms of Service from time to time. Any amendments will become effective upon publication by TEZISH through the application and website. The latest version of the Terms of Service is always posted on the TEZİSH application and website. Your continued access to or use of our services after such revisions constitutes your agreement to be bound by the revised Terms of Service. By using the Terms of Service, the User accepts and agrees that he cannot rely on the absence of any additional agreement in writing, paper format or any other form regarding the legal force and application of the Terms of Service.

2. Concepts

• Professionals: means natural persons who undertake to meet the one-time or recurring staffing needs requested by partners using the services of TEZİSH.

• Partners:  means individuals and legal entities who use the services of TEZISH and request to meet their one-time or recurring staffing needs in return for a predetermined fee.

• TEZISH application and website: refers to the TEZISH application and website created by "TEZISH" LLC for individuals and legal entities in order to meet the one-time or recurring staffing needs of TEZISH partners with the services of TEZISH professionals.

 

3. Description of TEZISH service

• TEZİSH creates, develops and manages application and website platforms where professionals connect and connect with partners to work on one-time or recurring business opportunities. Professionals and partners are hereinafter referred to as "users". If you agree to the terms of another user, you and the other user - directly between the two of you (Partners and Professionals) - undertake to enter into an appropriate (service, labor, etc.) contract and formalize the relationship between you in accordance with the legislation of the Republic of Azerbaijan. TEZISH does not participate in this stage and relations in any form and is not responsible in any case.

• Professionals and partners are independent contractors and not employees of TEZISH. These Terms of Service shall not be construed as creating a joint venture, partnership, employment or agency agreement or relationship between TEZİSH and you as a result of your use of the services.

• To use TEZISH services, you need to open an account and register for it. When you register for an account, you may be asked to provide certain information about yourself (such as your name, employment history, email address, phone number, profile picture, or other contact information). You agree that the information you provide to us is accurate, current and complete, and that you will keep the information up-to-date at all times. You will be asked to provide a password upon registration, and you are solely responsible for maintaining the confidentiality of your account and password and any password for Facebook, Google or other third-party access. You accept responsibility for all activities performed under your account. If you have reason to believe that your account is no longer secure, you must notify us immediately. TEZISH shall in no case be responsible for any losses, damages, liabilities, costs or attorney fees incurred by TEZISH or a third party as a result of unauthorized use of your account by someone other than you, regardless of whether or not you notify us of this. You agree that we may require you to provide information that may be used to verify your identity and ensure the security of your account.

• TEZİSH is not responsible for the quality of work of users, conversations with other users, quality of one-time or recurring work opportunities, timeliness, legality, enforceability or any other features. In addition, TEZİSH is not responsible for the accuracy, responsibility, professionalism or any actions or omissions of any user or for any ratings or reviews that users provide to each other.

4. General Terms and Conditions

​​​    4.1. TEZİSH has exclusive and full ownership rights over all service(s) and their results, including but not limited to software, images, writings, images, logos, trademarks, copyrights, photos, videos, music.

    4.2. Prohibited Uses: Using our Services in the following ways is strictly prohibited

• Share any service that competes with uscopying or using our services for the purpose of disposing or developing.

• Posting a link to any third-party web pages through our Services.

• Scrape, scan or otherwise use our service or any data or metadata associated with it to collect or compile information about users.

• Resell any information obtained while using our Service.

• Attempting to compromise the security of our Service in any way.

• Compiling, reverse engineering or deconstructing our Service in any way.

• Except as expressly permitted by TEZISH, reproduce, modify, license, distribute, rent, sell, resell, publicly display, broadcast, or otherwise create derivative works based on the exploitation of our service in any way.

• Harass, defame or discriminate against anyone or any entity for any reason.

 

5. Commission Salary and Payment

• Partners pay a one-time fee to TEZISH for professionals to work on one-time or recurring jobs using the TEZISH application and website. The responsibility of TEZISH is limited to the amount of commission earned. The payment to the Professionals by the partners is carried out by formalizing it in accordance with the legislation of the Republic of Azerbaijan through the appropriate contract (service, labor, etc.) concluded between them. TEZİSH does not participate in any form in the relations of receiving, transferring or executing payments between Partners and Professionals and is in no way responsible for the payment relations between the parties.

• Users can only fulfill this payment obligation using an online payment method. If the user has paid the required amount, the users' payment obligation is fulfilled. In addition, TEZİSH uses third-party payment service providers for payment processing.

• Any taxes and other mandatory withholdings arising from payment and contractual relationships between Partners and Professionals are the respective responsibility of such Partner and Professional.

 

6. Term and Termination

• These Terms of Service are valid as a binding agreement between TEZİSH and the user until further notice while using the TEZİSH service.

• The user can stop using the TEZİSH service at any time. TEZİSH may, at its sole discretion, at any time or for any reason, permanently or temporarily suspend the provision of the service or restrict the user's use of the service(s) or terminate the user's access to the service(s).

 

7. Privacy

• TEZİSH transfers the data of users (professionals and partners) only to each other for the purpose of offering one-time or recurring jobs to users as intermediaries.

 

8. Force Majeure

• The User and TEZİSH acknowledge and agree that the parties are not responsible for failure to fulfill their obligations under these Terms of Service as a result of force majeure. Force majeure cases include large-scale natural disasters, war, armed conflicts, decisions of state authorities and other persons that prevent the parties from fulfilling their obligations, etc. belongs to. If the force majeure event lasts for more than 3 (three) days, the party affected by the force majeure event shall inform the other party.

9. Legislation and Dispute Resolution

• These Terms of Service are interpreted and governed by the laws of the Republic of Azerbaijan. Disputes between TEZİSH and any User shall first be resolved through negotiation by informing TEZİSH through the contact provided herein. If the dispute cannot be resolved through negotiations, it can be resolved by other means in accordance with the legislation of the Republic of Azerbaijan.

This privacy notice states that "TEZISH"; LLC ("TEZISH"; "we";) processes personal data of users of TEZISH employment and staffing services ("TEZISH Application", "tezish.com") and uses this personal data commits to respect and protect them while doing so.

This notice describes how TEZİSH collects, uses and shares your confidential information. This notice applies to all users of our website and applications. TEZİSH reserves the right to change and update the privacy policy. Therefore, we invite users to review the modified or updated version on our application and website each time before making a decision to use our services.

 

This notice applies specifically to the following users

• Professionals: Individuals who meet one-time or recurring staffing needs requested by partners using the services of TEZISH.

• Partners:  To individuals and legal entities that use the services of TEZISH and request to meet their one-time or recurring staffing needs.

All persons referred to in this notice shall be referred to in this notice as “users”.

 

1. Information Collection and Uses

The following personal data collected and processed by TEZISH is for the proper performance of the contract between us. When you register to use TEZİSH services, create a user account, and share additional information to improve your user or company experience, you must provide us with the following information:

• Those submitted by users to TEZİSH include: Full name, email, address, phone number, username and password, profile picture, payment and bank information, ID card information (document number and date of birth, gender and photo), and driver's license information.

• The data generated during the use of TEZİSH services include:

• We collect users'; exact or approximate location information to monitor professionals'; performance of their duties, protect users'; safety, prevent and detect fraud, and comply with legal requirements. TEZİSH collects this information when the TEZİSH application is running in the foreground (the application is open and on the screen) or in the background (the application is open but not on the screen).

• TEZİSH also collects information related to the use of services. These include the type of service requested and undertaken, order details, payment transaction information, day and time of service, amount paid, service delivery period and payment method. In addition, if a user has used a promo code sent by another user, the name of the person who sent the promo code may be associated with the name of the user.

• TEZİSH collects information about users'; interactions with TEZİSH services. This includes the days and times users use the Services, the application and webpage viewed, application and webpage crashes, browser type, third-party sites or services visited prior to using our Services, and other device information (including device models, device IP address and or other unique device identifiers, software, preferred languages, advertising identifiers, and device movement and mobile network data).

• The collection of personal data by TEZISH can be carried out by collecting it as a result of using the Services by the User or directly provided by the User, when the User enters the TEZISH application or website and through a "cookie".

• User consent is valid for 5 years. After this period, personal data is destroyed or archived in accordance with the law.

 

2. Purposes and Legal Basis of Data Processing

Purposes: The processing of your personal data by TEZİSH has several purposes. These include providing TEZİSH services and fulfilling contractual obligations (legal basis: performance of contract and legitimate interest), for our legal obligations (legal basis: compliance with legal obligation), for handling claims and legal processes (legal basis: legitimate interest), includes use for customer communication and marketing (legal basis: legitimate interest) and for quality improvement and trend analysis (legal basis: legitimate interest).

 

3. Receivers

• We share your personal data only as far as possible for the purposes of this Privacy Policy of TEZISH. We do not share your personal data with third parties outside TEZİSH organization unless one of the following cases applies:

• We provide your information to a third party for the purposes specified in the Privacy Policy and when authorized service providers, such as partners'; staffing professionals, need access to personal information to perform our partners'; TEZISH services. In addition, we may provide your personal information to our affiliates and authorized service providers who provide services for us (including data storage, accounting, sales and marketing) or cooperate with us, payment service providers and partners for us.

• For legal reasons and legal processes, TEZİSH obtains and uses your personal information; (i) comply with any law, regulation or court order; (ii) we may share your personal information with third parties outside of TEZİSH to detect and prevent fraud, crime, security, or technical issues.

• For other legal reasons, if TEZİSH is involved in a merger, acquisition or sale of its assets, it may transfer your personal information to a related third party.

• TEZİSH does not guarantee information security related to situations that are directly related to the use of the Internet and are beyond its regulation and control.

• All cases related to personal data and information security that are not regulated by this Privacy Policy are regulated by the legislation of the Republic of Azerbaijan.

• Right of Access: You have the right to access and receive information about your personal data processed by TEZİSH.

• You have the right to withdraw consent.

• Right to rectification: You have the right to correct or complete any incorrect or incomplete personal data we hold about you by contacting us.

• You have the right to request the deletion of your personal data from our systems.

1. The TEZİSH application and website are not intended for children under the age of 18, and TEZİSH does not knowingly collect or store personal information about anyone under this age.
